If traffic police use uncertified equipment for inspection, the test results will be canceled and the inspector himself may be subject to disciplinary action, including penalties from management. Automobile lawyer Sergei Smirnov told Motor magazine about this. “This situation occurs extremely rarely, because the traffic police inspector understands that any inspection based on the readings of uncertified equipment can be unconditionally canceled in the future. For the inspector himself, this will cause many negative consequences, including the imposition of disciplinary measures by the management,” said the lawyer. According to him, even if the driver suspects that the inspector's equipment is not certified, he must still comply with legal requirements to be inspected. However, only the testimony of the certified device is decisive as to the law. Experts emphasize: the reading results of an uncertified device are not enough grounds to revoke a driver's license without a subsequent medical examination. Any decision on punishment must be based on evidence obtained within the law. Use of non-certified equipment is a violation and decisions based on such equipment may be overturned.
